Bolboreta Kids - Waiver Release Form

Release of Liability for Minor Participants

READ BEFORE SIGNING

IN CONSIDERATION OF my child/ward being allowed to Name of Minor Child/Ward participate in any way in the INKA Cottons LLC. (Bolboreta Kids) related events and activities, the undersigned acknowledges, appreciates, and agrees that:

The risks of injury and illness (e.g., communicable diseases such as influenza, and COVID-19) to my child from the activities involved in these programs are significant, including the potential for permanent disability and death, and while particular rules, equipment, and personal discipline may reduce these risks, the risks of serious injury and illness do exist; and,

1. FOR MYSELF, SPOUSE, AND CHILD, I KNOWINGLY AND FREELY ASSUME ALL SUCH RISKS, both known and unknown, EVEN IF ARISING FROM THE NEGLIGENCE OF THE RELEASEES or others, and assume full responsibility for my child’s participation; and,
2. If I observe any unusual significant concern in my child’s readiness for participation and/or in the program itself, I will remove my child from the participation and bring such attention of the nearest official immediately; and,
3. I myself, my spouse, my child, and on behalf of my/our heirs, assigns, personal representatives and next of kin, HEREBY RELEASE AND HOLD HARMLESS INKA Cottons LLC. (Bolboreta Kids); its directors, officers, officials, agents, employees, volunteers, other participants, sponsoring agencies, sponsors, advertisers, and if applicable, owners and lessors of premises used to conduct the event (“Releasees”), WITH RESPECT TO ANY AND ALL INJURY, ILLNESS, DISABILITY, DEATH, or loss or damage to person or property incident to my child’s involvement or participation in these programs, WHETHER ARISING FROM THE NEGLIGENCE OF THE RELEASEES OR OTHERWISE, to the fullest extent permitted by law.
4. I, for myself, my spouse, my child, and on behalf of my/our heirs, assigns, personal representatives and next of kin, HEREBY INDEMNIFY AND HOLD HARMLESS all the above Releasees from any and all liabilities incident to my involvement or participation in these programs, EVEN IF ARISING FROM THEIR NEGLIGENCE, to the fullest extent permitted by law.
5. In the event of an accident, injury, sickness, or other condition needing medical attention, and until I can be contacted, I hereby give my consent and permission for any and all medical attention and treatment to be administered to my child. I further agree that I am and shall be responsible for all costs associated with any injury or loss that may be sustained by my child as a result of his/her participation in any event or activities. I agree and acknowledge that in the event of a medical emergency, INKA Cottons LLC. (Bolboreta Kids) can call emergency medical services and render assistance and that I will be financially responsible for any expenses related to such services.
6. Further, I hereby consent and grant permission to INKA Cottons LLC (Bolboreta Kids), and each of their respective officers, employees, agents, successors, parents, affiliates, subsidiaries, sponsors, advertising and merchandising agencies, licensees, and assigns to use my child’s photograph(s), video(s), and/or other indicia of my minor child, in perpetuity, for any purpose, by any means and in any medium, whether now known or hereinafter developed. I understand that I shall not have any right to review or approve of any material within which my minor child’s photograph and/or video may appear, and I understand that may use such photographs or videos with or without associating names thereto. I further waive any claim for compensation of any kind for the use and/or publication of photographs and/or videos of my minor child. I hereby fully and forever discharge and release from any claims for damages of any kind (including, but not limited to, invasion of privacy; defamation; false light or misappropriation of name, likeness or image) arising out of the use or publication of photographs and/or video of my minor child, and covenant and agree not to sue or otherwise initiate legal proceedings against any of the above mentioned for such use or publication on behalf of my minor child.

I, FOR MYSELF, MY SPOUSE, AND CHILD/WARD, HAVE READ THIS RELEASE OF LIABILITY AND ASSUMPTION OF RISK AGREEMENT, FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT WE HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT, AND SIGN IT FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT.
